Terms of Service

Acceptance

These Terms of Service ("Terms") govern your use of the Plus1 platform and related services (the "Services"), provided by Plus1 ("Plus1", "we", "us"). By creating an account, by submitting information on a Plus1 guestlist or RSVP page, or by otherwise using the Services, you agree to these Terms.

The Services

Plus1 provides software that lets event organizers ("Organizers") build event pages, manage guestlists and a guest CRM, send communications by email and SMS for guestlist purposes, and run door check-in. Guests interact with Plus1 primarily through Organizer-built pages and through messages sent on an Organizer's behalf.

Accounts

Organizers must provide accurate information when creating an account and are responsible for activity that occurs under it. Keep credentials secure and notify us promptly of any unauthorized use.

SMS Messaging Terms (Guestlist Use)

Plus1 uses SMS to support event guestlists. The following terms apply to text messages sent through the Services:

  • Consent.By submitting your mobile number on a Plus1 guestlist or RSVP page, you consent to receive SMS messages from Plus1 on the Organizer's behalf for that event. Messages are used for guestlist purposes only — confirmations, event details, reminders, changes or cancellations, door check-in, and Organizer follow-ups.
  • Frequency.Message frequency varies by event and by the Organizer's communications.
  • Costs. Message and data rates may apply, depending on your wireless plan.
  • Opt out. Reply STOP to any Plus1 SMS to stop receiving further messages. Reply HELP for help, or email hello@useplusone.net.
  • Carriers. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed.
  • No marketing resale. We do not use your phone number for marketing unrelated to the event you signed up for, and we do not share or sell it with third parties for their own marketing.

Acceptable Use

You agree not to use the Services to: send unsolicited messages or otherwise violate applicable telecom and consumer-protection laws (including the TCPA, CAN-SPAM, and equivalent rules in your jurisdiction); upload contacts you did not obtain consent for; impersonate another person; transmit unlawful, harassing, or infringing content; or interfere with the operation of the Services.

Organizer Responsibilities (Imported and CRM Contacts)

When an Organizer uploads, imports, syncs, or otherwise adds contact information to Plus1 — including phone numbers — that did not originate from a Plus1 guestlist or RSVP page, the Organizer represents and warrants that:

  • Each contact has given the Organizer prior express consent to receive event-related communications from the Organizer, including SMS where a mobile phone number is provided;
  • The Organizer is authorized to provide each contact's information to Plus1 for the purpose of delivering those communications on the Organizer's behalf;
  • The consent obtained is sufficient under applicable law (including the TCPA and analogous state and international laws) for the category of communications the Organizer intends to send; and
  • The Organizer maintains records of consent and will honor opt-out requests (including STOP replies and any direct opt-out received outside of Plus1) promptly across all of its messaging.

Plus1 may require Organizers to confirm these representations at the point of import or send. Organizers remain solely responsible for the lawfulness of the contacts they bring to the Services and the content of messages they send.

Indemnification

Each Organizer agrees to defend, indemnify, and hold harmless Plus1 and its affiliates, officers, employees, and service providers from and against any claims, damages, liabilities, fines, penalties, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Organizer's breach of these Terms, including the representations in the "Organizer Responsibilities" section above; (b) the Organizer's collection, upload, or use of contact information without appropriate consent; (c) the content of messages the Organizer sends or causes to be sent through the Services; or (d) the Organizer's violation of any applicable law, including telecom and consumer-protection laws such as the TCPA, CAN-SPAM, analogous state laws, GDPR, and CCPA. Plus1 may, at its option, assume the exclusive defense and control of any matter subject to indemnification, and the Organizer agrees to cooperate with that defense.

Content and Data

Organizers retain ownership of the content and contact data they upload to the Services. Organizers grant Plus1 a limited license to use that content and data to provide the Services. Plus1's use of personal information is described in our Privacy Policy.

Beta Notice

The Services are currently offered in beta. Features may change, break, or be removed without notice while we improve the platform.

Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLUS1 WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Changes

We may update these Terms from time to time. If we make material changes we will provide reasonable notice. Your continued use of the Services after changes take effect constitutes acceptance.
